1. Who We Are and Scope of This Policy
This Privacy Policy describes how KIT Products, Co., a Delaware corporation doing business as PHASES (“PHASES,” “we,” “us,” or “our”), collects, uses, and shares information when you visit wearephases.com (the “Site”), create an account, or use the services made available through the Site (the “Services”). Our principal place of business is PMB 4018, 2600 W Olive Ave, 5th Floor, Burbank, California 91505. You can reach us at support@wearephases.com.
PHASES operates a technology and support platform. Medical care available through the Site is provided by independent, licensed healthcare providers affiliated with MD Integrations (the “Medical Group”), and prescription medications are dispensed by independent licensed pharmacies (the “Pharmacies”). A prescription from a licensed provider, issued after a medical consultation, is required before any prescription medication is dispensed.
Health information you provide in connection with medical care is protected health information (“PHI”) governed by the Health Insurance Portability and Accountability Act (“HIPAA”) and the Medical Group’s Notice of Privacy Practices, which is available on the Site. Where PHASES handles PHI on behalf of the Medical Group or the Pharmacies, it does so as a business associate under written business associate agreements, and HIPAA controls over anything inconsistent in this Policy.
2. Information We Collect

Identity and contact information. Name, date of birth, shipping and billing address, email address, phone number, and government-issued identification where required to verify your identity for telehealth services.

Health information. Medical intake questionnaire responses, health history, medications, lab results you provide or authorize us to receive, photographs you submit for clinical review, and records of your consultations and prescriptions.

Payment information. Payments are processed by third-party payment processors. We do not store full payment card numbers. We retain transaction records, payment method type, and billing history.

Device and usage information. IP address, browser type, device identifiers, pages viewed, and interactions with the Site, collected through cookies and similar technologies as described in Section 6.

Communications. Messages you exchange with our support team and, through the platform, with the Medical Group or the Pharmacies.
3. How We Use Information

To register your account, verify your identity, and facilitate consultations between you and the Medical Group.

To transmit prescriptions to, and coordinate fulfillment and shipping with, the Pharmacies.

To process payments, manage subscriptions, and send transactional communications such as order confirmations and shipping notices.

To provide customer support, respond to complaints, and manage adverse event reports in accordance with our published procedures.

To operate, secure, and improve the Site, prevent fraud and abuse, and comply with legal obligations.

With your consent, to send marketing communications. You may opt out at any time using the unsubscribe link in any marketing email or by contacting us.
4. How We Share Information
We do not sell your personal information, and we do not share your health information for third-party advertising. We share information only as follows.

The Medical Group and its providers, so that licensed providers can review your intake, conduct consultations, and issue prescriptions where clinically appropriate.

The Pharmacies, to fill valid prescriptions and ship medications to you.

Platform and service providers, including our telehealth infrastructure provider MD Integrations, LLC, cloud hosting, identity verification, payment processing, analytics, and customer support vendors, in each case bound by contract to use information only to provide services to us, and bound by business associate agreements where they handle PHI.

Legal and safety disclosures, where required by law, subpoena, or court order, or where necessary to protect the rights, safety, or property of you, PHASES, or others.

Corporate transactions, in connection with a merger, financing, acquisition, or sale of assets, subject to confidentiality protections and continued application of this Policy or one at least as protective.
5. Consumer Health Data
Some states, including Washington and Nevada, regulate “consumer health data” collected by entities not fully covered by HIPAA. Our standalone Consumer Health Data Privacy Policy, linked in the Site footer, governs that data, and this section summarizes it. We collect the categories of health data described in Section 2 for the purposes described in Section 3, we do not sell consumer health data, and we do not process consumer health data for targeted advertising. You may exercise the rights described in Section 8, including the right to withdraw consent and to have your consumer health data deleted, by contacting support@wearephases.com.
6. Cookies and Analytics
We use strictly necessary cookies to operate the Site, and analytics cookies to understand Site usage. We configure our analytics and advertising tools so that health information, intake responses, and patient status are not shared with advertising platforms. 7. Data Retention and Security
We retain personal information for as long as your account is active and as needed to comply with legal obligations, including medical record retention laws applicable to the Medical Group and the Pharmacies. We use administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including encryption of data in transit using Secure Socket Layer (SSL/TLS) technology, encryption at rest for health information, access controls, and workforce confidentiality obligations. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Rights and Choices
Depending on your state of residence, you may have the right to know what personal information we have collected about you, to access a copy of it, to correct it, to delete it, to opt out of targeted advertising, and to not be discriminated against for exercising these rights. California residents have these rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act, including rights regarding sensitive personal information. We do not sell or share personal information as those terms are defined under California law.
To exercise any right, email support@wearephases.com with the subject line “Privacy Request”. We will verify your identity before responding and will respond within the time required by applicable law. You may authorize an agent to act on your behalf. If we decline a request, you may appeal by replying to our decision, and we will respond to appeals within the period required by applicable law. Rights of access and amendment for medical records held by the Medical Group are governed by HIPAA and the Notice of Privacy Practices.
9. Children
The Site and Services are intended for adults 18 years of age or older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us personal information, contact us and we will delete it.
10. Changes to This Policy
We may update this Policy from time to time. We will post the updated Policy on the Site with a revised effective date, and where changes are material we will provide additional notice, such as email notice or a prominent Site banner. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
