1. Scope
This Consumer Health Data Privacy Policy explains how KIT Products, Co., a Delaware corporation doing business as PHASES (“PHASES,” “we,” “us”), collects, uses, and shares consumer health data in connection with wearephases.com (the “Site”) and the services offered through it. It applies to information that identifies or is reasonably linkable to you and that identifies your past, present, or future physical or mental health status, as defined by applicable state consumer health data laws, including the Washington My Health My Data Act and Nevada Senate Bill 370. Health information held by the independent medical group and pharmacies that provide clinical services is protected health information governed by HIPAA and their own privacy notices, and is not covered by this Policy.
2. Consumer Health Data We Collect
Depending on how you use the Site, we collect the following categories of consumer health data. Health-related order information, meaning the products and services you purchase or subscribe to, which may reveal health status. Health-related account and support communications you send us. Measurements or goals you choose to share with us outside the clinical intake, such as survey responses. Inferences drawn from the foregoing, such as interest in a wellness category. We do not collect precise geolocation data, and we do not use geofencing around health care facilities.
3. Sources
We collect consumer health data directly from you when you create an account, place an order, respond to surveys, or contact support, and from your use of the Site as described in the Privacy Policy. We do not purchase consumer health data from data brokers.
4. Purposes
We use consumer health data to provide the products and services you request, process orders and subscriptions, provide customer support, prevent fraud and misuse, comply with legal obligations, and, with your consent where required, send you marketing communications. We do not sell consumer health data, and we do not process consumer health data for targeted advertising.
5. How We Share Consumer Health Data
We share consumer health data only with the following categories of recipients. Service providers bound by contract to process the data solely on our behalf, including our telehealth infrastructure provider, payment processors, cloud hosting, and customer support vendors. The independent medical group and pharmacies, to coordinate the services you request. Government authorities where required by law. A successor entity in connection with a merger, acquisition, or sale of assets, subject to this Policy. We have no affiliates with whom consumer health data is shared. We do not share consumer health data with third parties for their own use.
6. Your Rights
You have the right to confirm whether we collect, share, or sell consumer health data about you and to access that data, including a list of the third parties with whom we have shared it. You have the right to withdraw any consent you have provided for the collection or sharing of your consumer health data. You have the right to have your consumer health data deleted. We will not discriminate against you for exercising these rights.
7. How to Exercise Your Rights; Appeals
Email support@wearephases.com with the subject line “Consumer Health Data Request.” We will verify your identity before responding and will respond within the time required by applicable law. If we decline your request, we will explain why, and you may appeal by replying to our decision. We will respond to your appeal within the period required by applicable law, and if the appeal is denied, we will provide a method to contact your state Attorney General.
8. Changes and Contact
